Datedick Terms of Service (TOS)

1. No Adult Content
Datedick is a social network and members share personal social media (user generated content) like photos, videos, text and audio. Adult content, as determined by Ning and Google, is not allowed. Please don't upload x-rated profile photos and content. No cock, no ass, no bulge grabbing. Every profile has to have a face photo. WHEN YOU CHANGE YOUR PROFILE PHOTO FROM G-RATED TO X-RATED YOU WILL BE BANNED PERMANENTLY.

2. Declinded Membership and Banning
We reserve the right to decline memberships, ban members and delete profiles without explanation. Reasons for decline can be: No invitation, no personal non-adult profile photo, nonsense or incorrect data, adult content. inactive profiles. Members can invite others but there is no guarantee that member invitations get accepted.

3. Proprietary Rights in Content on Datedick
By displaying or publishing ("posting") any content, messages, text, files, images, photos, video, sounds, profiles, works of authorship, or any other materials (collectively, "Content") on or through Datedick, you hereby grant to Datedick, a non-exclusive, fully-paid and royalty-free, worldwide license (with the right to sublicense through unlimited levels of sublicensees) to use, copy, modify, adapt, translate, publicly perform, publicly display, store, reproduce, transmit, and distribute such Content on and through Datedick.

You can select whether your profile and content is only visible to signed-in Datedick members or you can select "profile is visible to all". Then Datedick has the right to decide for whom and for what consideration profiles and content will be visible or not. You cannot demand that your profile and content will be always visible to non signed-in visitors. These steps provide the necessary privacy control.

4. Featured Member Photos
If the privacy settings of your photos are set to "Anyone" we have the right to select the best shots to be listed on "Featured Photos" on Datedick. These photos will be visible on the News page on Datedick. Featured photos will also be used to promote the services of Datedick on other sites like Facebook, Yahoogroups, Blogs (to list only a few) and in the Datedick Facebook apps. Featured photos will be color graded, cropped and will have a tag line named. "Datedick. Where real men meet."

You can contact the moderator to have your photo removed. To prevent that your photo could be featured just set the privacy (who can view your photo) individually or globally to "Just My Friends" or "Just Me".

5. No Spam
Please don't spam. Spam is annoying. What is spam? Spam is posting the same message repeatedly across the network. Spam is writing the same post or comment over and over again. Spam is sending the same message to multiple members. We take a hard line view on spam and, unfortunately, if you are reported or deemed by us to be a spammer, we'll have to ban you here on Datedick.

6. Insults and Harassment
Respectfully disagreeing with someone - including us - in a well-reasoned manner is welcomed. We want to get better so we like constructive feedback from you. On the other hand, if you're here to find an outlet for your anger, frustration, or desire to write EVERYTHING IN ALL CAPS over and over again, this isn't the right place. Drop us a note by clicking on Report and Issue or send a Feedback" to get whatever it is off your chest. We take threatening, nonconstructive, toxic, profane, or generally abusive people very seriously and will ban fast when we see them. Even if you have a right to be angry or frustrated, yelling at us or other Datedick members isn't helpful and won't get you what you want. Just like in the real world.

7. Copyrighted Content
Although it's fun to share hot stuff please consider what you do before you upload. Don't share copyrighted content like videos (and parts of it), music videos, music and pictures. We encourage you to only share your own content like homemade photos and videos, web cam videos, your own music and remixes and your own art and graphic.

Those are the precautions against copyrighted materials on Datedick.com

- We provide adequate notice to members that uploading copyrighted material is prohibited.

- We comply with DMCA takedown notices and remove content on the same day the notice is received (or within a few days thereafter).

- We take measures to control infringing users. Infringing accounts are terminated and the email banned from any new accounts.

- We cannot review every file but we spot check photos and videos, and if they do, remove content that is likely infringing.

8. No Child Pornography
You cannot post any content containing child pornography. Datedick absolutely does not tolerate this and will report any suspected instances of child pornography, including reporting any member data, to law enforcement, including the National Center for Missing and Exploited Children. Members who don't follow these rules will be banned without warning.

9. Advertisment
We reserve the exclusive right to sell, run and/or serve third-party advertising on Datedick. We will have the option, which we may exercise on notice to you, to offer and display, in partnership with you, advertisements on Datedick. Don't post ads or URL links that could be considered as ads without talking with us first. We might ban your without warning.

10. Mailings/Broadcasts
Datedick will periodically send out messages to all members (broadcasts). Topics can be: Featured members and photos, new content, news and interesting sponsor links. The frequency can be daily (or less) and occasionally several a day (mostly on weekends and holidays). Every broadcast contains a link at the bottom from where you can control which emails you receive on Datedick. Click here to set it now. We cannot individually remove members from the broadcast list you have to do it yourself.

Some member who have been banned can still receive broadcasts. This is not intentional and unfortunately out of the moderators control. But you can report this at help.ning.com. Scroll down and click on "Send us your question." Log-in, describe your problem and you will get help.
